Ana Gerdau de Borja Mercereau specialises in international disputes.

She acts in commercial and investment arbitration, commercial and investment mediation and in dispute boards.

 

Ana Gerdau de Borja Mercereau has represented clients in more than 20 arbitrations. Global institution rules she has acted under include the International Chamber of Commerce (ICC)’s, the International Centre for Dispute Resolution (ICDR/AAA)’s and the International Centre for Settlement of Investment Disputes (ICSID)’s. She has also acted under the most important Brazilian institutions’ rules (CAM-CCBC, CCMA CIESP/FIESP, CAMARB, Câmara FGV, CAM-BM&FBOVESPA and CMA from São Paulo’s Instituto de Engenharia).  She has also worked as secretary to various arbitral tribunals.

 

Her cases have included large infrastructure projects (in construction, renewable energy, oil & gas and transportation), M&A deals, and projects for mining research and exploration. These cases involved:

  • one of the largest French retailers;

  • one of the world’s largest public relations group;

  • a Scandinavian investor in the energy sector;

  • large Brazilian oil & gas players;

  • one of the world’s largest sports apparel company;

  • one of the largest Brazilian railway concessionary; and

  • one of the world’s largest food processing company.

She is an associate at Derains & Gharavi, Paris. She was an associate at Cleary Gottlieb Steen & Hamilton, Paris (2015-2017), and at Wald, São Paulo (2010-2015), a Legal500 1st tier Brazilian law firm.  She features on global and regional panels of arbitrators.

 

Ana Gerdau de Borja Mercereau has contributed actively to the international arbitration community:

  • She participated in the ICC Task Force on the Revision of ADR, Expert and Dispute Board Rules (2013-2014); she helped create dispute board rules of a major Brazilian dispute resolution institution.

  • She has founded the Investment Arbitration Group of the Brazilian Arbitration Committee (CBAr). She is a member of the Chartered Institute of Arbitrators (MCIArb), of the Dispute Resolution Board Foundation (DRBF), of ICC Brazil, of the International Arbitration Institute (IAI), and of Arbitral Women (AW).

  • She is the author of more than 40 publications.She teaches the master course on private international law at Université Paris-XIII.

Ana Gerdau de Borja Mercereau received the “Women in Law Award” (Lawyer Monthly) in 2014. She has featured in professional rankings (Legal500, LatinLawyer250 and GAR100, 2013).
